My Adventure as a Juror

I’ve received jury summons three times in the past and each time I was fortunate enough to avoid the civic duty that everyone dreads.  That is, until now.

I thought it unusual to get an afternoon jury summons but considering the number of courthouses we have in Houston I suppose it makes sense to have two big batches of jurors a day.   Since the jury summons included free Metro transportation fair I decided to take the MetroRail from the other side of Reliant Park and all the way up to the courthouse area (almost the entire train route).  I must say it is a nice way to get into downtown.  I didn’t have to wait long and the trains seemed to stay on a schedule.

Once I go to the appropriate building I waited around in the jury assembly for an hour before they broke us up into several groups.  Each group went their seperate ways and followed their bailiff to a courthouse.   We discovered that we were assigned to a misdemeanor case so it was to the 9th floor of the criminal courthouse for us. The entrance to the courthouse has the same sort of security you’d find at the airport.  I even had to take off my shoes.  The place was teaming with people from potential jurors to employees and of course a gaggle of civilians.  We piled into a huge elevator and headed up to the 9th floor.

After waiting in the hall for about 30 minutes we finally got into the courtroom for jury selection.  Voir Dire itself went on for a good two hours.  The judge and the attorneys really broke it down to a 5th grade level when they’re addressing the potential jurors.  Seeing as I was #3 on the list it was safe bet that I ran a good chance of getting picked.  Based on both the defense and the prosecutor’s questions, it was pretty obvious that the case involved a DWI where the defendant refused to take a sobriety test.  There were a lot of questions about the signs of intoxication and what is considered reasonable doubt.  The assistant D.A. was fairly new and seemed very nervous but she did nothing wrong that I could tell (we later learned it was her 3rd case).  The defense attorney was pretty slick having obviously been well practiced in DWI cases (I found his fancy website after the trial).  He had a fancy chart of various degrees of determining guilt and it was a powerful tool to persuade jurors on how to determine reasonable doubt.  By the end of Voir Dire, I heard my name called out and was told to return in the morning as a juror for the trial.

The next morning I took the MetroRail back to the courthouse and sat through the proceedings.  We heard opening statements and two witnesses that were cross examined by both attorneys.  In the middle of it all we got to take a lunch break and eat some great food at The Cloister on the taxpayer’s dime.  It was an actual church with food from a place called Treebeards.  I had the red beans and rice with sausage and jalapeno cornbread.  Good stuff!  With full bellies we returned to the courtroom and heard the rest of the cross examination and closing statements before breaking to deliberate.

The story was told by two witnesses: a 19 year old man from across the street and the arresting officer.  The story was that the defendant drove through the neighborhood at 4am and on four seperate occasions peeled out in the street.  He then drove with his lights out and parked in a driveway.  The 19 year old witness had his friend call the cops to report a suspicious car while he went across the street to get a closer look.  The young man found the defendant sleeping or passed out behind the wheel.  The young man knocked on the window but failed to wake the man.

The cop showed up and he too knocked on the window and also could not wake the man.  The cop then opened the truck door, identified himself and poked the defendant with his flashlight.  The defendant woke up, started the ignition and tried to put it in drive.  The office struggled with the defendant, held the gearshift to keep it from getting in gear, and conked the defendant in the head with his flashlight.  He then pulled the defendant out of the truck by his shirt and after a struggle, handcuffed him and stuck him in his patrol car.   While in the patrol car, the defendant knocked his head against the window several times.  At the station (they had a REALLY shitty quality video) the officer tried to administer a sobriety test but the defendant refused and said nothing.  In the video some of us could see him swaying but not all of the jurors.

So that’s what we had to go on.  We deliberated for two hours and simply could not come to a unanimous decision.  Reasonable doubt is so vaguely defined that it made it difficult for many of us without undeniable proof which I guess is the whole reason it went to trial.  The prosecuting assistant district attorney defined reasonable doubt as a feeling that sits well with you.  The defense defined it as being beyond a firm belief.  In reality, what is reasonable to one person is not to another.  By 5pm we still could not come to a verdict so the judge sent us home to sleep on it and to return in the morning to continue.

Sleeping on it and then going over the evidence again in this morning actually swayed two jurors (myself and one other) to guilty which meant we were even at 3 guilty and 3 not-guilty.  There was no way we were going to come to a unanimous decision.  On the far guilty side we had a non-practicing attorney who was sold on guilty after the policeman spoke.  On the far not guilty side we had a Hispanic mother who said she simply could not convict him.  I personally think it was because she sympethized so much with the defendant since he was also Hispanic and close to the same age as one of her sons.  The rest of us were various shades between the two.

By noon we still made no progress and so the judge brought us back into the courtroom and the defense motioned for a miss trial.   After the trial the judge spoke to us and apologized for making us deliberate for so long (we sent 3 notes to the courtroom telling them that we could not reach a unanimous decision and each time the judge replied for us to keep trying.)  The judge really was super nice and very well spoken.  The attorneys then came and spoke to us asking us what made us decide the way we did and what did we have problems with.  I could tell that the defense attorney was hella frustrated since he’s going to have to go through this all over again.  The Assistant D.A. was much more cheerful about it experience.  Personally, I think it was a learning experience for her and she’d probably like the chance to do it again and brush up on her presentation.

It was certainly an experience I will not soon forget.  I actually enjoyed most of it except for having to come back again today since I knew when I went that there was no way this jury could reach a unanimous decision.  I guess it will be several months before they get a chance again for closure.

Prologue: I almost forgot!  In the elevator heading down from the courthouse (this is after the trial) a gentleman in the elevator asked if we were the jurors from courtroom #5 (we were).  He mentioned that he was friends with both attorneys and did we know that the defendant had already had a DWI convinction on his record?  Obviously we didn’t and we were all very surprised to hear it.  It helped us who thought he was guilty feel better about our decision and those who thought him not guilty had to have pondered their decision.  In the end it was good that we did not know that since it obviously would have tainted our impartial judgement but it’s still curious to learn after the fact.

Jet Fuel!

Never before has coffee been so METAL!

My order of Jet Fuel arrived today from Amazon and I am stoked!  I love my Keurig coffee maker and finally I have found a brand of coffee that is worthy of my glorious automated caffeine delivery system!  I HEARD the hairs on my chest grow after just one cup!  That’s what I’m talkin’ about!

Five Years Flew By

Today I received a certificate for five years of service with the company. It came in a nice little display holder with a fancy VISA gift card that I will be spending shortly. My five year anniversary was technically back in February but I’m not complaining. In today’s economy I was pleasantly surprised to even receive this token of appreciation.

I can honestly say that so far I’ve enjoyed working for my employer.  I’ve had three supervisors and each one has taken care of me so far.  In five short years I’ve gone from Help Desk Analyst to Help Desk Team Lead to Branch Support Supervisor to Desktop Support Supervisor and then finally to my current position as a Change Management Analyst.  In retrospect, I’ll admit that moving out of support and into change management and project management was a good career change for me.  I enjoyed being the goto guy when I was working in support but honestly it was starting to get a bit old hat.  Now that I’m doing something very different I just need to get off my ass and start expanding my knowledge by learning more about ITIL and PMO.

Good Ol’ Richmond River

It started raining long before I went to bed last night and didn’t stop until it was time for me to go to work.  The news said that flooding was a problem this morning but hell I live in Houston.  When isn’t it a problem?  Well, lets just say I didn’t get very far when I tried to drive my 2 mile commute.  The parking garage was flooded.  The sidestreet McCue was flooded.  Richmond was flooded.  The parking lot across the street was flooded!  I’ve already learned the hard lesson of driving in water so I wised up quick and turned my happy ass around.

Here it is 3 hours later and it hasn’t rained for at least a couple hours yet still there is water on Richmond.  It’s not nearly as high as it was but it’s still a considerable amount of water.  I’m glad I have the luxury of working from home.  People driving through that mess are just crazy!

Here’s an interesting flood gauge map I found showing the rainfall totals during the last 12 days. I circled the guage closest to my apt.  If a gauge is noticeably lower than surrounding ones, it probably means the gauge was inoperable at some point during the time period. (Thanks SciGuy!)

Fancy Eatin’

Today Ruen and I ate lunch at Smith & Wollensky’s.  For those of you like me who would havta Google the resturant to know anything about it, Smith & Wollensky’s is a New York based steakhouse “chain” resturaunt that caters to the upper crust steak lovers.  I guess it’s not technically a chain or franchise since they only have a handful of privilaged locations but according to what I’ve read this place is supposed to be THE place when it comes to getting a steak.

Since it was just a quick lunch, Ruen and I had simple burgers.  Well, to be clear I had their specialty burger and Ruen had their steak sandwich (which ironically enough was a decision inspired by his love for The Dresden Files novels).  Both of our meals were pleasent.  Considering the price I wouldn’t go so far as to call them 5 star OMFG pew pew-my-brain-just-got-slapped-by-my-tongue sort of awesome but it was a good meal.  Unlike most dining experiences, it was the service that made it stand out.

Our waiter sat us and took our drinks.  Our waiter tried to serve us wine.  Our waiter kept giving my tea a refill whenever it got down to 80% full.  Our waiter must have checked up on us about a dozen times during our 45 minute luncheon.  Our waiter cleaned up the bread crumbs that Ruen left (I know I made crumbs as well but I guess I cleaned my own).  Our waiter cleaned up the bit of onion that Ruen’s sandwich left on our tablecloth and to cover up the stain the onion left our waiter dropped a fresh white cloth napkin over it.   When I needed to take a leak the waiter escorted me to the restroom.  I was relieved (no pun intended) when he didn’t offer to hold my wang while I did my bidness.

When we were done our waiter brought by this cart full of desserts and went throught his 5 minute dissertation on the glories of desserts as his displayed each sweet treat.  After we said no thanks to his tempting treats I swore I could see genuine hurt on his face as if we somehow made him feel like he failed us.

All in all it was probably the oddest dining experience I’ve ever had.  I’m satisfied if a waiter (or waitress) gives me a refill when I’ve just hit empty or comes by a couple times after our meal has been served to make sure all is well.  I’m the sort of guy that usually tips 2 bucks at every meal as “the standard” and on occassion will tip a few bucks more if the service was hella awesome.  However, after this dining experience I guess I now know what I’d consider excessive when it comes to satisfying my dining needs.  Maybe it has to do with my psuedo-countryfied upbringing or perhaps my resistance to the pomp upper crust dining experience.  Give me refills when I need em and some more chips and salsa when I run out and I will tip you twice as much as I usually do.  Treat me like I’m more special than I am and I’ll probably tip a percentage of the tab because you freaked me out with your excessive catering.

Would I go back?  Eh.  Probably not unless I was trying to swoon some lady with some upscale dining.  Fancy eats are not my bag.

Vacation Day Two: Errands, TV, WoW and Beer

Tuesday began with a rage inducing visit to Wal-Mart to get my oil changed.  I don’t know why I didn’t just goto Jiffy Lube like I always do.  Even though they’re a few bucks more than the Wallaria at least they’re quick and well mannered.  No, Instead I decided to take my truck to Wal-Mart where I was greeted with apathy and sourness that I’ve personally come to now expect from most Wal-Mart personnel.  They were unattentive and two faced when it came to how they spoke to customers and how they talked amongst themselves.  I’m sure the job would be awesome if it werent for the customers but damn at least treat the customer like you value their patronage.  I guess I shouldn’t be surprised by such souless presentation from those working for so little and for such a big corporation.  Still, call me jaded or snobbish but with the unemployment rate being as high as it is you would think those who actually have jobs would strive to do their best.  Or, those who employee others would have the luxury of finding employees who want to work and want to do a good job.  It didn’t help matters that their printer kept jamming and they’re idea of troubleshooting was to remove the tray and put it back, remove the tray and put it back, remove the tray and put it back, remove the tray and toner and put it back.  I now have a glimpse of the madness one must experience by looking upon the Old Ones.

The rest of the day was decidedly more enjoyable.  I caught up on my favorite sitcoms, played some WoW (dinged 78!) and drank some beer.  I decided to give Flying Dog’s variety pack a try and It was enjoyable.  All of the flavors I sampled were very rich and full tasting if not a big syrupy.  I’d recommend them to others although I doubt they’ll enter my list of favorite brews.  A funny sidenote: As I twittered my mini reviews I actually got a response from someone who apparently works for Flying Dog.  He liked my pumpkin pie reference.

I Made this Post With Windows Live Writer

Today I installed Microsoft’s new and free blogging application Windows Live Writer and now I’m giving it a go.  It was a pretty painless install and I’ve already downloaded and installed a few nifty plug-ins for it.  I’m impressed how it easily pulled down the formatting from my WordPress theme and thus gives me an perfect example of how the post will look when I publish it.

The reason for trying a native application for blogging isn’t instantly apparent since composing blog posts offline isn’t really an issue for me.  I think the image editing capabilities and added functionality of plug-ins will determine the staying power of using this application.

Here are a couple interesting items I can insert:

Microsoft Maps

Map picture

Now that’s kind of nifty.  I typed in my zip code and drug the map over to my apartment complex.  I had the option of just a standard map or this satellite view.

Videos

Inserting YouTube videos (or Soapbox) is easy enough.  It doesn’t appear to support YouTube’s new letterbox formatting.  I’m sure that will come with future updates.  I did have to leave the application, look up the video and copy the url first so that’s a bit of an ass biter but it wasn’t difficult.

Photo Album

Now this looks pretty slick.  I selected a few photos I had saved and it put that neat little collage together.  There are several Album styles (this one is called Spread) and they’re all pretty attractive.  Bummer animated gifs don’t work (two of those pictures were supposed to be animated).

Polaroid Picture Plug-In

Pretty neat effect although my iphone photo makes for a long Polaroid picture.

It’s a pretty simple application and seems to have some neat tools so we’ll see how long it keeps my attention.  The fact that it’s free is certainly in its favor! :)

Screenshot or it didn’t happen!

It’s not everyday that it snows in Houston.  Hell, it’s not every year that it snows in Houston.  Yet here we are in early December and big ol’ snowflakes are falling.  Of course, it’s not cold enough for the stuff to stick but that hasn’t stopped folks from grinning and taking silly pictures like yours truly.  I’m sure in two days i’ll be running around in short pants again but for now I guess I’ll enjoy nature’s air conditioner for a few days :P
